All services offered by Lux Booking Global are subject to these terms and conditions, or Conditions. Please carefully read these terms.

1. Acceptance of these Terms and Conditions

    1. When Lux Booking Global (LBG) receives instructions or requests for information from you (you or the Customer) regarding the provision of travel-related services and related information, such as locations of travel, times of cruises or flights, dates and prices, lodging, transportation, insurance, currency, and schedules (Services), the Customer acknowledges receipt of these terms and conditions and agrees to be bound by them. LBG is authorized to act on behalf of the Customer in compliance with the Condition by any instructions it receives for the provision of Services.
    2. The following clauses—10, 12, and 13—which limit or exclude LBG’s liability and the amount of time the Customer has to file a claim against LBG—are specifically called out to the Customer’s attention.
    3. Except as allowed by applicable laws, nothing in these conditions is meant to have the effect of contracting out of any applicable provisions of applicable laws in any of Cayman Island’s territories. Whatever in these Conditions shall be construed as a surrender by LBG of any rights or immunities, or as an increase of any of its responsibilities or liabilities under such legislation. If any part of these Conditions is in conflict with such legislation to any extent, such conflict will only apply to the extent that it affects the business in question. If any legislation is mandatory for any Services, then these Conditions shall be read as subject to such legislation as regards such Services.

2. Travel and agency details

    1.  In order to fulfil the Customer’s requests and deliver the services, LBG acts as the Customer’s agent only, and the Customer hereby expressly authorizes LBG to enter into any and all contracts on the Customer’s behalf that may be required or desirable. LBG does not enter into a service agreement with the Customer as an agent (other than the agency services). Rather, LBG ensures the security of any Services by negotiating contracts with third-party service providers on the Customer’s behalf, creating a direct contractual connection between the Customer and said third parties. LBG bears no responsibility for the actions or inactions of said third parties. LBG disclaims all liability for the services provided by these third parties and makes no representations or warranties about their information or standards.
    2. Subject to the terms and conditions and liability limitations imposed by the third-party service providers, all reservations are made on behalf of the customer. The Customer understands that all claims must be made against the appropriate third-party service providers, whose own terms and conditions apply to the Services, unless otherwise specifically allowed by these Conditions. Upon request, LBG will furnish you with copies of the pertinent terms and conditions from third-party service providers.
    3.  Third-party service providers provide us with the information we provide about the Services. Regarding information provided to us by such third parties, we take no liability. We advise you to verify with the third-party service provider any information that appears on or is linked from the information we give the customer.

3. Costs

    1. LBG reserves the right to change the price of any travel reservation. All quoted prices are contingent upon availability and are subject to change or withdrawal at any time. Price adjustments could take place as a result of events beyond our control that drive up the cost of the good or service, as well as changes made by the third-party service providers who provide us with information. Unfavourable currency fluctuations, fuel surcharges, taxes, and fare increases are a few examples of these factors. For current rates, please get in touch with LBG whenever possible.
    2. The quoted amounts are all payable in the currency of their quotation. If foreign exchange fees are associated with a charge, your credit card company will apply them; LBG has no control over them. Please note that until the amount is charged, the amount quoted will always be approximated in your home currency.
    3. With the exception of LBG’s fees, we accept all other payments from the Customer for the Services in our capacity as the third-party service provider’s agent. Your recourse is against the third-party service provider and not against LBG if, for any reason, they are unable to provide the services you have contracted for. You acknowledge that if we receive payment from you using a credit card, you will not attempt to chargeback, recoup your money, or pursue any other losses from us.
    4. Before full payment is received, all air-only prices are subject to change and cannot be guaranteed. To safeguard the price of the air alone on the reservation, the full amount owed must be paid.
    5.  Your reservation may be cancelled if LBG does not receive the final payments by the balance due date that your LBG consultant has specified to you.

4. The requirements for passports, visas, and travel documentation and standards.

    1. The general requirements are outlined below.

      All travellers must have a valid passport and/or visa for international travel, and many countries require at least six months validity from the date of return. Some countries require a machine-readable passport. The Customer agrees to ensure that all travellers’ passports and visas are in good condition.

    2.  As the departure dates draw near, the Customer and each individual traveller must confirm the requirements for travel documentation. If the necessary travel documents are not provided, the carrier or the appropriate authorities may deny you the ability to travel, and there will be no other options or chance for a refund.

5. Travel Insurance

    • LBG strongly advises travellers to obtain suitable travel insurance to protect their travel plans, including sufficient coverage for medical costs, personal injury, luggage loss, and trip cancellation or delay. For any international trip, it is also highly advised to purchase travel insurance. It is the Customer’s duty to make sure that travellers have enough insurance for their trip. We have made the process of purchasing travel insurance very simple, and we highly recommend that you do so in order to protect yourself before you travel. 6. Immunizations and Health

    • The Customer is responsible for making sure that travellers have all required vaccination records and are aware of any health requirements and suggested precautions specific to their trip. Travelers may not be allowed entry into a country if they do not have the necessary vaccination records and health documentation, and in certain cases, international health certificates are also necessary.

7. Fees for Amendments and Cancellations

    • Reservations that are changed or cancelled may be charged. Whether or not travel has started, these fees may total 100% of the original booking price. If a reservation is altered or new tickets or documentation are issued, additional fees and charges might also be incurred. In the event that the Customer cancels or modifies a reservation for which LBG is liable, the Customer agrees to reimburse LBG for any associated costs.

8. Other Fees and Taxes

    • Even if the entire fare has been paid, each cruise line or supplier retains the right to collect any increase in taxes or port fees that are in force at the time of sailing or travel. In the event that this happens, LBG is in charge of collecting any increases on behalf of the cruise line or supplier. Additionally, the cruise lines retain the right, at their discretion, to alter an itinerary or port of call. In certain airports, there might also be a local tax or surcharge that the passenger must pay.

9. Acceptance of these Terms and Conditions

  1. Dates and times by which LBG is required to perform under these Conditions shall automatically be postponed to the extent and for the duration that LBG is prevented from meeting them by causes beyond its reasonable control, unless otherwise expressly provided in these Conditions. Among these causes are, but are not restricted to:
    • Any condition that is actual, threatened, or reported that is outside of LBG’s reasonable control; or any delay, demand, circumstance, or requirement that is caused by, directly or indirectly, any of the following: weather, acts of God, riots, civil unrest, embargoes, wars, hostilities, terrorist threats, disturbances, or unstable international conditions;
    • Any inability to provide services by any third-party service provider; or

    • Any lockout, slowdown, work stoppage, strike, or other dispute pertaining to the workplace; or
    • Any mandate, requirement, or regulation from the government; or
    • Any shortage of fuel, labour, or other resources at LBG or elsewhere; or

      anything that cannot be reasonably expected, predicted, or foreseen,

      referred to as “Force Majeure” here.

10. Liability and Limitations

    1. The Customer understands and accepts that LBG shall not be liable, in contract or otherwise, for any harm, damage, loss, delay, or events resulting from a Force Majeure, nor for any further costs or expenses resulting from the mistakes, omissions, or default of third-party service providers.

    2.  The only third-party service provider that the Customer may legally pursue for any harm, damage, loss, delay, extra cost, or inconvenience is that particular third-party service provider, unless the loss was directly caused by LBG’s wilful misconduct. The Customer agrees to make claims only against the third-party service provider and further agrees not to make any claims against LBG unless the customer’s claim is solely attributable to LBG’s gross negligence, in the event that any third-party service provider is unable to provide the services for which the Customer contracted.

    3. LBG’s liability may also be restricted to the extent that any other applicable law or convention restricts the amount of compensation that travellers can claim for passenger death, injury, or delay, as well as for luggage loss, damage, and delay. Examples of such conventions are the Athens Convention for sea travel, the Berne Convention for rail travel, and the Paris Convention for lodging.

    4. Under no circumstances will LBG be held responsible for indirect or consequential losses, including but not limited to loss of market share, loss of profit, or the results of any delay or deviation, regardless of how the delay or deviation occurred, even if LBG was aware that such losses might occur.
